Terms and conditions of sales and guarantee

All new products purchased from MT Shop online store by private individuals are covered by a guarantee of at least 24 months; for legal persons, the guarantee period specified by the manufacturer applies. To handle your guarantee issues faster, please have the following information on hand before calling or writing:

1. Invoice or order number

2. Serial number (S/N) of the purchased product (if available)

 

 

1.     Guarantee

1.1 KMS Projektiabi OÜ mediates the manufacturer’s guarantee and guarantee procedures for the equipment sold. We do not carry out any guarantee repairs ourselves. In the absence of an authorized service representative in the territory of Estonia, guarantee repairs are performed through KMS Projektiabi OÜ by the importer or the manufacturer’s factory.

1.2 Guarantee service is provided based on the invoice issued by KMS Projektiabi OÜ and the purchased appliance with an undamaged serial number. If the serial number of the appliance is damaged or unreadable, the performer of the guarantee repairs has the right to refuse free guarantee repairs.

2.     Guarantee Period

2.1 All goods purchased by private individuals in the MT Shop online store have a guarantee of at least 24 months. In the case of legal persons, guarantee period specified by the manufacturer applies.

2.2 The guarantee period is calculated from the date of delivery of the product to the buyer.

2.3 The guarantee period is suspended for the period of time when the buyer is unable to use the product due to non-compliance with the terms of the contract, for which the issuer of the sales guarantee is liable (guarantee repair period).

2.4 The length of the guarantee period and the duration of the response or maintenance period are determined by the importer of the goods.

2.5 Guarantee is void without proof of purchase and the guarantee certificate that came with the product.

3.     Implementation of guarantee repairs

3.1 Guarantee repairs are carried out by the authorized service representative of the manufacturer. In the absence of an authorized service representative in the territory of Estonia, guarantee repairs are performed through KMS Projektiabi OÜ by the importer or the manufacturer’s factory.

3.3 If it proves impossible to repair the appliance during the guarantee period and its production has ceased, the manufacturer or importer replaces the appliance with an equivalent or better appliance under guarantee, and if the buyer does not agree with the replacement, he/she has the right to withdraw from the contract of sale.

3.4 In addition to the rights arising from the guarantee, the customer also has other rights arising from law (e.g., the right to submit claims pursuant to § 218 (2) of the Estonian Law of Obligations Act).

4.     Guarantee Exclusions:

4.1 Wear parts (batteries, toner cartridges, printheads, floppy disks, CDs, mouse pads, etc.), packaging and documentation.

4.2 User’s data that has been lost due to appliance failure or guarantee repairs. It is the customer’s responsibility to back up the data before submitting the appliance for guarantee repairs.

4.3 Software, including software preinstalled on the appliance and malfunctions caused by the software.

4.4 Malfunctions and physical damage resulting from unintentional or intentional physical damage or foreign objects, liquids, insects, excess dust, etc. inside the device.

4.5 Malfunctions and physical damage due to faulty electrical systems (lacking ground wire etc.), power failure or mains voltage fluctuations.

4.6 Malfunctions and physical damage due to the use of non-original parts or inappropriate accessories.

4.7 Malfunctions caused by improper use of the appliance and non-compliance with the requirements of the operating instructions (using the product in unusual environmental conditions).

5.     The guarantee does not apply

5.1 If the product has been physically damaged or improperly maintained.

5.2 In case of violation of the rules or conditions of use indicated in the operating instructions if the product has been used inappropriately.

5.3 If the owner has attempted repair the product or the product has been repaired by a third party unknown to KMS Projektiabi OÜ.

5.4 If the product serial number or product number is damaged or unreadable.

5.5 To naturally worn appliances and parts.

6.     Return Policy

6.1 Upon receipt of the order, the customer (private person) has the right to withdraw from the purchase contract concluded in the MT Shop online store within 14 days without giving reasons. 14 days purchase contract withdraw does no apply to companies (juridical person).

6.2 If the condition of the returned product has deteriorated, the customer shall be liable for the decrease in value due to the use of the product only if he/she has used the product in a manner other than necessary to ascertain the nature, characteristics and functioning of the product. To ascertain the nature, characteristics and functioning of the product, the customer should handle and use the product only as he/she would normally be allowed to do in the store, i.e., the returned product may have been previously removed from the package and inspected, but must still be new, unused, in the original packaging and with original labels attached.

6.3 To return the goods, the customer must draw up a written declaration of withdrawal from the purchase contract and send it to address info@mts.ee no later than 14 days after the receipt of the goods. You can find a standard withdrawal declaration form here.

6.4 The seller (MT SHOP / KMS Projektiabi OÜ) does not undertake responsibility to buy back low-moving goods that have been specially ordered for the customer from the factory or from external suppliers with the customer's consent. This fact applies both on the basis of a written and oral agreement, regardless of whether the client is a private person or a legal entity.

6.5 The customer must return the goods within 14 days of submitting the declaration of withdrawal or provide proof that he/she has handed over the goods to the logistics company within that period.

6.6 Return fees will be covered 100% by the customer.

6.7 Upon the receipt of the declaration of withdrawal, MT Shop shall return to the customer immediately, but not later than within 2-7 days, all fees received from the customer under the contract, including the delivery cost used by the customer, unless the customer has expressly chosen a method of delivery other than the cheapest method of delivery offered, MT Shop does not have to reimburse the customer for a cost that exceeds the cost of the usual method of delivery. The costs of returning the product shall be borne by the customer unless otherwise agreed.

7.     Complaints Process 

7.1 MT Shop is liable for non-compliance or defect of the goods sold to the buyer, which already existed at the time of delivery, and which become apparent within two years from the delivery of the goods to the buyer. During the first year from the delivery of the goods to the buyer, it is presumed that the defect already existed at the time of delivery of the product. It is the seller's responsibility to rebut this presumption.

7.2 In the event of a defect, the customer has the right to contact MT Shop within two months at the latest, submitting proof of purchase.

7.3 If defects appear, the customer is required to stop using the product, as it may worsen the defect.

7.4 Repair or replacement of defective goods shall be agreed between MT Shop and the customer. The cost of repairing or replacing the product will be borne by the seller.

7.5 MT Shop shall not be liable for any defects in the product caused by the customer, which have arisen because of improper storage or improper use of the product.

7.6 In case of non-compliance or defects of the product, please forward your complaint to e-mail address info@mts.ee, indicating the name and the contact number of the buyer, as well as the order number and exact description of the non-conformity or defect of the product. The basis for submitting a claim is not the non-compliance of images of products and/or services with reality, i.e. images of all products and/or services are indicative/illustrative and may differ from the actual product and/or service. The basis for submitting a claim is considered to be the fact that the customer receives a product whose product code does not match what was advertised on the product page.

7.7 A complaint for non-conformity or defect of a product must be submitted within two months from the discovery of the non-conformity or defect of the product.

7.8 All complaints will be reviewed, and the customer will be contacted as soon as possible, but not later than within 14 days from the receipt of the complaint.

7.9 The consumer has the right to demand from the seller the reduction of the purchase price or the termination of the contract and to recover money for the goods if the seller is unable to repair or replace the goods, the repair or replacement of the goods fails, or the seller has not repaired the defect of the goods within a reasonable time or unreasonable inconvenience has been caused to the customer.

8.     Force Majeure

8.1 MT Shop shall not be liable for damages caused to the customer or for delays in the delivery of goods if the damage or delay in the delivery of goods is due to circumstances that MT Shop could not influence or foresee.

9.     The consumer’s right to apply to the Consumer Disputes Committee (www.komisjon.ee)

9.1 If MT Shop has refused to handle the customer’s complaint or the customer does not agree with the solution offered by MT Shop and considers that his/her rights or interests have been violated, the customer may file a complaint with the Consumer Disputes Committee through the Consumer Protection and Technical Regulatory Authority or with the court. The customer may file the complaint personally or through a representative. The contacts of the Consumer Disputes Committee are available on the website of the Consumer Protection and Technical Regulatory Authority (www.ttja.ee). To address any cross-border consumer disputes, the procedure is described and a complaint can be filed with the European Union Consumer Centre. The Consumer Disputes Committee resolves disputes arising from contracts concluded between buyers and sellers. The review of the buyer’s complaint in the Committee is free of charge. 

10.  www.mts.ee, including MT Shop, is a trademark of KMS Projektiabi OÜ. The legal address of KMS Projektiabi OÜ is Osmussaare 4, Tallinn, 13811, Estonia. It is not possible to receive the ordered goods or ask for additional information related to products, services or orders from that address.

11.  The purchase and sale transaction between the buyer and the seller (KMS Projektiabi OÜ) takes effect from the moment the invoice is paid.

12.  Payment for the goods is made by invoice (bank transfer), bank link, hire purchase, debit or credit card or e-invoice (Fitek). All prices displayed in the MT Shop online store include 20% VAT.

13.  Unless otherwise agreed, price offers are generally valid for 7 days.

14.  If the goods are acquired with credit (hire purchase) and the customer withdraws from the purchase or service contract based on § 56 of the Law of Obligations Act, then the customer is deemed to have also withdrawn from the related consumer credit agreement based on § 57 of the same Act.

15.  The minimum term of contract shall be communicated to each buyer individually according to the characteristics of the purchase transaction.

16.  According to § 90 (1) of the General Part of the Estonian Civil Code Act, MT Shop can unilaterally cancel a transaction and return to the customer what was received, if the transaction was entered into under the influence of a relevant mistake (system error, supplier side (delivery warehouse) error, e.g., a price that is significantly lower than the market price, incorrect stock quantity, etc.) or something else the seller could not foresee.
